The following terms and conditions below govern the sale of goods from Giftshubs (the seller) to you (the buyer).
1. Pricing
1.1 The price payable for the goods will be set out on the website at the time the seller accepts the order from the buyer
1.2 An order may be placed by the buyer following a written quotation from the seller in which case the price for the goods will be detailed in the said quotation
1.3 The seller reserves the right to vary the price of the goods to reflect an increase or decrease in cost to the seller. The seller will contact the buyer prior to delivery should this be the case.
1.4 If the product is no longer available the seller will endeavour to offer the buyer a suitable alternative.
1.5 The buyer shall be responsible for any charges of VAT & carriage in addition to the costs of goods unless otherwise agreed with the seller.
1.6 Unless otherwise agreed the seller must receive payment for the total price of the goods and any applicable charges for VAT & carriage from the buyer prior to acceptance of the order. In the event that the goods have to be backordered or are not available the buyer will be given the option to cancel the order.
1.7 If the buyer has a credit account with the seller, payment for the goods shall be made in full within 30 days of the date of the invoice sent to the buyer from the seller. The seller shall be entitled to revoke any credit terms if the buyer fails to pay within the 30 day period of the invoice date.
2 Delivery and Title
2.1 A ‘working day’ is defined as Monday, Tuesday, Wednesday, Thursday or Friday excluding UK public holidays.
2.2 Delivery is restricted to the UK. For deliveries outside the UK contact us as per 4.1 .
2.3 Delivery of the goods shall be made by the seller to the UK address of the buyer as stipulated in the order.
2.4 Any dates quoted for delivery of the goods are approximate and the seller will not be liable for any delay in delivery of the goods howsoever caused.
2.5 UK orders placed before 5pm will be dispatched to the buyer within 2-3 working days.
2.6 The above delivery arrangements do not apply to certain UK geographical areas. For Scottish Islands, Isle of Wight, Isle of Man, Northern Ireland, Jersey and Guernsey two further working days are applicable
2.7 Goods under 2kg will be sent Royal Mail 1st Class or Special Delivery. It is the buyer’s responsibility to pick up goods from the relevant Royal Mail depot if the buyer has failed to take delivery of the goods. Royal Mail do not consider an item as lost until 15 working days have elapsed.
2.8 Goods over 2kg will be sent by Parcel Force 48. If the buyer fails to take delivery of the goods then without limiting any other right or remedy available to the seller, the seller may store the goods until actual delivery and charge the buyer for the reasonable costs (including insurance) of storage.
2.9 Risk of damage to or loss of the goods shall pass to the buyer: a) in the case of the goods to be delivered at the buyer's premises, at the time of delivery or, if the buyer wrongfully fails to take delivery of the goods, the time when the seller has tendered delivery of the goods: b) in the case of goods being collected from the seller's premises, at the time when the seller notifies the buyer that the goods are available for collection.
2.10 Title to the goods will only pass to the buyer once the seller has received the full price of the goods, including VAT and carriage. If the buyer fails to pay the full price of goods, the seller may at any time require the buyer to deliver up the goods to the seller or the seller may enter any premises of the buyer or any third party where the goods are stored to repossess the goods. All reasonable expenses of the seller related to goods recovery will be charged to the buyer.
3 Availability
3.1 The seller shall endeavour to hold sufficient stock to meet all orders, however if there are insufficient stock to supply the buyer for goods already paid for, the seller will back order the goods for the buyer and quote an estimated delivery date or offer a suitable alternative. The buyer will always be notified and have the option to cancel their order if they do not accept the new delivery date or the alternative.
3.2 For bespoke products, the total quantity delivered will be plus or minus 2% of the total order, charged pro-rata.
4 Cancellation and Returns
4.1 The buyer shall be entitled to cancel their order within 48 hours of the delivery date. The buyer can notify the seller by the following contact details:

4.2 On cancellation the buyer will return the goods at their own cost unless the goods being returned are incorrect or faulty, in which case the seller will arrange for the goods to be collected by their nominated carrier.
4.3 If the buyer wishes to cancel an order for bespoke products, notice must be given within 2 days of placing the order. Any such cancellation shall be subject to a fee in respect to any work performed by the seller up to the date of receipt of such notice.
4.4 Cancellation of an order requires the products to be returned in complete and original condition and packaging. The buyer is required to ensure such goods shall be returned to the seller safely & securely to ensure that they are returned undamaged and suitable for re-sale. All cancelled orders may be subject to a 20% re-stocking fee.
5 Liability
5.1 Any defect in the quality, quantity or conditions of the goods shall be notified by the buyer to the seller, as per 4.1, on receipt of goods. If the buyer does not notify the seller accordingly, the buyer shall have no right to reject the goods and the seller will not accept liability for such defect, the buyer will be required to pay for the goods in full.
5.2 The seller will inspect the goods returned and if the defect is identified the buyer will be given the option of replacement goods at no additional cost or a full refund. The seller will have no further liability to the buyer.
5.3 The seller will inspect the goods returned and if no defect is identified the goods will be returned to the buyer at the buyers cost.
5.4 The seller under no circumstances is liable to the buyer for any loss of profits, additional costs, indirect or consequential loss or damage arising out of any defect in goods supplied. The sellers liability will be restricted to the value of the goods returned. This does not affect your statutory rights as a consumer, nor is it intended to exclude the sellers liability to the buyer for fraudulent misrepresentation or for death or injury resulting from the sellers negligence.
5.5 The seller shall be under no liability in respect to any defect in the goods arising from any artwork or specification supplied by the buyer.
6 Force Majeure
6.1 The seller shall have no liability to the buyer for any failure or delay in supply or delivery or for any damage or defect to the goods supplied or delivered caused by any event or circumstances beyond the sellers reasonable control.
7 General
7.1 The validity, legality or enforceability of any part of these terms and conditions will be unaffected by the invalidity, illegality or unenforceability of any individual part of these terms and conditions.
7.2 The terms & conditions shall be governed by & interpreted in accordance with English Law.
